Which law governs your divorce depends first on your personal law, and only then on the specific ground or relief you're seeking. Here is what actually governs a matrimonial matter filed in Bhopal today, and where it gets heard.

For Hindus, Sikhs, Jains and Buddhists, the Hindu Marriage Act, 1955 governs both mutual consent and contested divorce, along with maintenance under Section 24/25. Interfaith and civil marriages fall under the Special Marriage Act, 1954. Muslim divorce follows personal law and the Muslim Women (Protection of Rights on Divorce) Act, 1986, while Christian divorce is governed by the Indian Divorce Act, 1869.

Regardless of personal law, maintenance can also be claimed under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (the post-2024 successor to Section 125 CrPC), and protection from domestic violence is separately available under the Protection of Women from Domestic Violence Act, 2005. All matrimonial proceedings in Bhopal are heard by the Family Court, which follows the Family Courts Act, 1984 — a simpler, less adversarial procedure than an ordinary civil suit.
